The Federal Constitutional Court ruled in a provisional consideration that the neutrality obligation had more weight than the freedom of religion of the accused legal counsel.
"The judges of law, who appear as representatives of state power and are perceived as such, must also comply with the state's neutrality," the decision published on Tuesday.
The Hessian Ministry of Justice had forbidden the lawyer to lead court rulings during his training with headscarf or to represent the prosecutor's office. Karlsruhe saw in it only a temporally and locally limited intervention in the freedom of religion. The prohibition does not affect the vast majority of training in working groups. A final decision on the constitutional complaint of the Muslim will only be given at a later date (Ref. 2 BvR 1333/17).
